Course Description

Economic and diplomatic relationships between the United States and Germany have resulted in significant economic interaction between the two countries. Many German resident have well-established business interests within the United States, and U.S. taxpayers – both individuals and entities - maintain similar interests in Germany. Tax advisers serving clients with ties in both countries require familiarity with the laws of each, to ensure (with collaboration from advisors in the other jurisdiction, and with reference to the U.S./Germany tax treaties) effective global tax rates are minimized.
 
Looming over tax treatment of American taxpayers with cross-border activities are extensive U.S. information reporting requirements. Germany is a participant in global bank and asset disclosure programs, and U.S. taxpayers with presence in Germany must coordinate their U.S. disclosures with required German tax filings.  German-specific factors also are critical in classifying a foreign interest for United States tax purposes, with classification ultimately dictating which filings are required.
 
The program will also cover US tax compliance related to US Persons living and working in Germany. A brief overview of how US source income affects Nonresidents in the context of the US-Germany tax treaty is included as well. The program will focus on options to avoid double taxation as well as options available to become compliant. Finally, it will provide a brief discussion regarding the provisions of the Foreign Account Tax Compliance Act and the importance of additional declarations when preparing US tax returns for US persons living in Germany.

Mr. McCormick is a primary and prolific authority on tax matters. He has spoken on all aspects of international tax to hundreds of thousands of attendees around the globe, functioning as the primary international tax resource for national organizations including CPAacademy.org, Strafford, Lawline, and Leimberg Information Services. Patrick has presented for the American Bar Association, the American Immigration Law Association, and state and local bar associations around the United States. He is a regular contributor to America’s premier tax law publications, including Tax Notes, Journal of Taxation, Tax Notes International, Law360, and Practical Tax Lawyer.

Mr. McCormick published his first treatise on international tax matters, Allocation and Apportionment Rules Under Secs. 861-865, for Thomson Reuters’ Catalyst platform, in October 2021. In late 2021, he also released a 15-hour digital course entirely dedicated to nonresident taxation, United States Tax Considerations for Nonresident Taxpayers. Mr. McCormick has been named a Super Lawyers Rising Star from 2016-2022.

Sarah is a German citizen working as a US CPA in Berlin, Germany. She used to be a US Permanent Resident and lived, studied and worked in the US for many years. She now specializes in US expatriate taxation, as well as US taxation of Non-US Residents. Many American citizens live and work in Germany and they are required to file both US and German income tax returns. Sarah works closely together with the German tax advisors of the parent company of W + P US Tax Services GmbH, Wagemann + Partner PartG mbB. It is their goal to serve the needs of this special client group and ultimately avoid any double taxation.
